HART — A 27-year-old Walkerville man convicted of a misdemeanor of indecent exposure was sentenced to six months probation in 78th District Court Monday, Aug. 6.

Luis Gerardo Montemayor, of 6362 N. 192nd Ave. initially faced a high-court misdemeanor of aggravated indecent exposure after flashing a woman in her 70s as she walked down the road in Leavitt Township.

The more serious charge was dismissed when Montemayor pleaded “no contest” to the lesser charge.

He was arrested July 17 by the Oceana County Sheriff’s Office.

He was allowed to be released from jail Monday as long as there are no other holds for his incarceration, said Judge H. Kevin Drake.

Montemayor pulled up in a vehicle and asked the woman if she wanted a ride. As he approached the woman, he was fondling himself and masturbating in front of her, said Oceana County Chief Assistant Prosecutor Chad DeRouin.

His probation requires that he abstain from alcohol and drugs and have no contact with the victim. He is subject to counseling, searches and testing as required by his probation officer. The judge also ordered one year discretionary jail and fines and costs totaling $1,085.
