27th Circuit Court sentencings

HART — The following were sentenced Thursday, April 2, by 27th Circuit Court Judge Anthony Monton:

– Scott Edward Overly, 30, of 2928 Eighth St., Muskegon Heights, was found guilty Feb. 2 of uttering and publishing. He was sentenced to one year in jail with credit for 19 days served; sentence to be served at the court’s discretion with six months forthwith;18 months probation; $510 in restitution; $198 in fines and costs; no alcohol/drugs; must submit to testing; must complete treatment programs referred by the field agent; and may not engage in any assaultive, abusive, threatening or intimidating behavior. One count of forgery was dismissed.

– John Mark Tufts, 46, of 6910 Holton Duck Lake Rd., Holton, was found guilty Feb. 3

of third-offense operating under the influence of liquor (OUIL). He was sentenced to one year in jail with credit for 63 days served; $750 in fines and costs; and driver’s license is revoked. One count of second-offense driving while license suspended (DWLS) and one count of alcohol – open container were dismissed.

– Rosario Arias, 46, of 7584 N. 140th Ave., Hart, was found guilty Feb. 17 of food stamps – fraud over $1,000. She was sentenced to 90 days in jail with credit for one day served; sentence to be served at the court’s discretion; $11,147.64 in restitution payable to the State of Michigan; $198 in fines and costs; two years probation; must execute a wage assignment to pay restitution if employed; financial assessments to be paid during probation term; may not engage in any assaultive, abusive, threatening or intimidating behavior; must make genuine efforts to find and maintain employment for a minimum of 30 hours per week unless engaged in an alternative program approved by the field agent.
