78th District Court sentencings

HART – The following were sentenced this week by 78th District Court Judge H. Kevin Drake:

–      Joshua John Roberts, 34, of 7590 N. 186th Ave., Walkerville, was found guilty Sept. 23 of operating under the influence of liquor (OUIL), second offense. He was sentenced to 90 days in jail; one year discretionary jail; $665 in fines and costs; three months probation; no alcohol/drugs; subject to counseling, testing and searches as required by probation officer; outpatient substance abuse counseling; and many not purchase or possess a firearm. Conviction reportable to SOS. One felony count of OUIL, third offense, was dismissed.

–      Forrest Adam Mills, 23, of 5790 George Rd., Pinckney, was found guilty Oct. 20 of operating while impaired. He was sentenced to 93 days discretionary jail; must complete substance abuse evaluation recommendation; and $1,040 in fines and costs. Conviction reportable to the Secretary of State (SOS). One count of operating while intoxicated was dismissed.

–      Jesus Ismeal Zarzoza-Garcia, 20, of 2080 E. Madison Rd., Hart, was found guilty Oct. 20 of operating a motor vehicle without security. He was sentenced to one year discretionary jail and $400 in fines and costs.

–      Zachary Ryan Machovsky, 23, of 8460 S. 80th Ave., Montague, was found guilty Oct. 20 of operating while impaired. He was sentenced to 93 days discretionary jail; Alcohol Highway Safety Education (AHSE); and $1,055 in fines and costs. Conviction reportable to SOS. One count of operating while intoxicated was dismissed.

–      Terry Lee Barrett, 55, of 1572 W. Tyler Rd., Hart, was found guilty Oct. 20 of operating while intoxicated. He was sentenced to 93 days discretionary jail; outpatient treatment; and $1,155 in fines and costs. Conviction reportable to SOS.

–      Jenne Zoe Samuel, 54, of 818 E. First St., Pentwater, was found guilty Oct. 21 of allowing a person under the influence/intoxicated to operate a motor vehicle. She was sentenced to 93 days discretionary jail and $400 in fines and costs. One count of operating while intoxicated was dismissed.

–      Brandon Dean McCann, 23, of 511 S. Courtland St., Hart, was found guilty Oct. 20 of third-degree retail fraud. He was sentenced to $253 in fines, costs and restitution and 93 days discretionary jail.

–      Richard Wesley Roberson, 60, of 8850 E. Newfield, Hesperia, was found guilty Oct. 20 of tobacco products tax act. He was sentenced to $450 in fines and costs and 90 days discretionary jail. One count of tobacco product tax act – miscellaneous violations and one count of tobacco product tax act violations were dismissed.

–      Wayne Clark Oliver, 62, of 4885 N. Wayen Rd., Pentwater, was found guilty Oct. 20 of controlled substance, possession of marijuana. He was sentenced to one year discretionary jail and $440 in fines and costs. Conviction reportable to SOS.
