District Court sentencings

HART – The following were sentenced recently in 78th District Court:

–      David Theodore McDaniel, 45, of 4825 W. Wayne Rd., Pentwater, was found guilty July 21 of disorderly person – jostling. He was sentenced to 90 days discretionary jail and $400 in fines and costs.

–      Duane Allan Priese, 35, of 9441 E. Lane Dr., Montague, was found guilty July 21 of operating while impaired. He was sentenced to 93 days discretionary jail; outpatient treatment; and $1,040 in fines and costs. Conviction reportable to the Secretary of State (SOS). One count operating while intoxicated was dismissed.

–      Andrew Scott Henion, 24, of 2725 Forest St., Rothbury, was found guilty July 21 of operating while intoxicated. He was sentenced to 93 days discretionary jail; Alcohol Highway Safety Education (AHSE); and $1,190 in fines and costs. Conviction reportable to SOS. One count of transporting open intoxicants was dismissed.

–      Joseph Scott Elwell, 40, of 3455 Algonquin Dr., Norton Shores, was found guilty July 21 of operating while impaired. He was sentenced to 93 days discretionary jail; must complete substance abuse evaluation recommendation; and $1,040 in fines and costs. Conviction reportable to SOS. One count of operating while intoxicated was dismissed.

–      Jaime Garcia, 21, of 500 Fowler St., Shelby, was found guilty July 21 of allowing a person to drive in violation. He was sentenced to 90 days discretionary jail and $225 in fines and costs.

–      Phillip Edward Houston, 50, of 8 N. Courtland St., Hart, was found guilty July 21 of disorderly person – drunk. He was sentenced to 90 days discretionary jail and $400 in fines and costs.

–      Joseph Darnell Mitchell, Jr., was found guilty July 21 of allowing a person to drive in violation. He was sentenced to 90 days discretionary jail and $225 in fines and costs.

–      Sean David Strait, 47, of 18270 Hickory St., Spring Lake, was found guilty July 21 of driving while license suspended (DWLS). He was sentenced to 93 days discretionary jail and $400 in fines and costs. Conviction reportable to SOS.

–      Gerald Russell Burns, 24, of 127 Sessions Rd., Shelby, was found guilty June 23 of operating while intoxicated. He was sentenced to 93 days discretionary jail; outpatient treatment; six months probation; $615 in fines and costs; no alcohol/drugs; subject to counseling, testing and searches by probation officer; and is not to purchase or possess a firearm. Conviction reportable to SOS. One count of DWLS or letting a suspended person operate, second offense, and one count of operating a motor vehicle without security were dismissed.

–      Fredrick George King, 57, of 3193 W. 108th Ave., Grant, was found guilty July 21 of allowing a person to drive in violation. He was sentenced to 90 days discretionary jail and $225 in fines and costs.

–      Brandon Allen Loss, 20, of 5086 Wayne Rd., Pentwater, was found guilty July 21 of disturbing the peace and sentenced to 90 days discretionary jail.

–      Mark Andrew Kelly, 30, of 224 Terra Circle, North Muskegon, was found guilty June 30 of operating while intoxicated. He was sentenced to three weekends in jail; 93 days discretionary jail; $1,565 in fines and costs; six months probation; outpatient treatment; no alcohol/drugs; subject to counseling, testing and searches by probation officer; and may not purchase or possess a firearm. Conviction reportable to SOS. One felony count of operating under the influence of liquor, third offense, was dismissed.

–      Wayne Arnold Johnson, Jr., 53, was found guilty July 21 of controlled substance – use of marijuana and operating while impaired. For Count I, he was sentenced to 90 days discretionary jail; six months probation; outpatient treatment; $700 in fines and costs; no alcohol/drugs; subject to counseling, testing and searches by probation officer; and may not purchase or possess a firearm. For Count II, he was sentenced to 93 days discretionary jail and $1,155 in fines and costs. Convictions reportable to SOS.

Gilberto Juarez-Almanza, 24, of 3289 Arthur Rd., Rothbury, was found guilty July 23 of forest fires – no burning permit. He was sentenced to 90 days discretionary jail and $325 in fines and costs.
